CONDITIONS OF PARTICIPATION

The following conditions apply:

1 Organiser

WARIMEX Waren-Import-Export-Handels GmbH, Chiara-Ambra-Platz 1, 77743 Neuried ("STONELINE") is organising a product test under the motto "Become our product tester!" in the implementation period from 22.09.2023 at 00:00:01 CET to 31.12.2023 at 23:59:59 CET.

By participating in this product test competition, you agree to give STONELINE the following consent in exchange for the chance to be a product tester:

I consent to STONELINE using my title, full name, email address provided, full postal address and date of birth to send personalised newsletters by email and to use my newsletter and competition behaviour to improve personalised promotional activities across the board. I give this consent voluntarily.

You have the right to revoke your consent at any time with effect for the future and to unsubscribe from the newsletters at any time. However, unsubscribing from the newsletters before 15 January 2024 will result in exclusion from this competition. The revocation of consent does not affect the lawfulness of the data processing until the time of revocation.

In order to participate in the competition, registration for our newsletters is required until the end of the competition period.

By participating, you accept the following conditions of participation.

2 Conditions for participation

In order to participate in the product test, a person must fulfil all of the following criteria:

The participating person is a natural person and has reached the age of at least 18 years.

The participating person has his or her permanent residence and address for service in the Federal Republic of Germany.

The participating person is taking part in the product test exclusively as a private person and not in the context of his/her self-employed professional or commercial activity.

The participating person undertakes to publish a review of the product on his/her own public Instagram account and to link STONELINE to it.

The participating person agrees that the STONELINE review may be posted on the STONELINE Instagram account.

The participating person undertakes to read the instructions for use and to use the product accordingly. Any claims for damages as described in section 7 paragraph 3 remain unaffected.

In the period from 22.09.2023 at 00:00:01 CET to 31.12.2023 at 23:59:59 CET on the website www.stoneline.de/produkttester, the participating person has selected a product test with the possibility of a free trial and has filled in the application form with the mandatory details of first name, surname, street, house number, postcode, town, email address, Instagram user name and date of birth and has confirmed the conditions of participation and registration for the STONELINE newsletter and has sent it by pressing the "Apply now!" button.

The participating person will receive, if they have not yet subscribed to a STONELINE newsletter, after entering the above data, a newsletter registration link by email to the email address provided, which they must confirm by calling up by 23:59:59 CET on 31.12.2023 at the latest. If the link has not been confirmed within this period, the newsletter must be subscribed to again at www.stoneline.de/newsletter. Please note that this link is only valid for 7 days for technical reasons. With the confirmation of the e-mail address via the registration link, the participating person automatically takes part in the raffle. The STONELINE newsletter welcome e-mail sent confirms receipt of your application. If the registration link does not work as described in individual cases, please feel free to contact us at info@stoneline.de. Those who have already subscribed to the STONELINE newsletter will only receive the STONELINE newsletter welcome email as confirmation.

Participating individuals may be required to provide proof of their eligibility to participate in the product test. If participants do not provide evidence of their eligibility within the time limit set by STONELINE, STONELINE reserves the right to exclude you from participation.

All persons registered by 31.12.2023 at 23:59:59 CET will automatically be entered into the prize draw, provided that the entries have also been confirmed via the method described above. All unregistered entries will expire on 01.01.2024 at 00:00:01 CET.

3 Product test

All participating persons have the chance to receive a 3-piece gourmet roaster set from STONELINE for a product test.

4 Execution and settlement

Raffle

The product testers will be selected from all participants who have applied for the product test and subscribed to the STONELINE newsletter and who do not unsubscribe from the newsletter before 15 January 2024. The selection will always be made on the 30th of each month at 23:59:59 CET by random draw.

A maximum of one 3-piece gourmet roaster set can be won per participating person.

Notification and transmission of the product

All product testers will be notified by e-mail of their upcoming product test. The email address cannot be changed after registration. In the event of non-delivery of the product, STONELINE is not obliged to make further enquiries and there is no entitlement to the product test.

Product test and evaluation

The selected product tester will receive a prize notification and instructions on how to conduct the product test by email. The free product will then be sent by post. The product tester undertakes to follow the instructions for the product test exactly.

The product test includes the publication of a review of the product on the tester's own public Instagram account and the linking of STONELINE therein. The type of publication (e.g. as Instagram reel, story or post) is left up to the product tester.

Approximately one month after receipt of the product, the tester will be reminded by email to rate the test product.

The contents of the evaluation will be used in anonymised form for advertising measures of the WARIMEX group of companies.

After completion of the test and submission of the evaluation, the tester may keep the product.

Please note that we are regularly looking for product testers. So check regularly to see which current product tests are waiting for your application.

5 Exclusion of participants

STONELINE reserves the right to exclude participants from the product test due to violations of the conditions of participation, false information, premature unsubscription or non-confirmation of the newsletter link, manipulation or use of unauthorised aids.

In the event of exclusion, products may be subsequently withdrawn or products already delivered may be reclaimed.

6 No transfer of prizes

If it is not possible to send a prize to the winner (e.g. due to an incorrect e-mail address), STONELINE reserves the right, at its own discretion, to use the product in another way (e.g. to give the product for award to participants who have not been selected or to use it for another product test or another competition).

7 Disclaimer

Technical or other problems beyond the control of STONELINE are not subject to the liability of the operator.

Any warranty claims of the winners are excluded.

Claims for damages of the participating person against STONELINE shall only exist insofar as they are based on injury to life, body or health, on the violation of cardinal obligations of STONELINE or on an intentional or grossly negligent breach of duty by STONELINE, its legal representatives or vicarious agents. Cardinal obligations are those obligations the fulfilment of which enables the proper performance of the contract in the first place and the observance of which the contractual partner may regularly rely on.

8 Modification/cancellation of the product test

Errors and misprints excepted.

STONELINE reserves the right to change or discontinue the product test in case of unforeseen circumstances. In particular, STONELINE is entitled to terminate, cancel or suspend the product test in case of

an attempted misuse by manipulation is detected or
a proper execution is no longer guaranteed, for example due to hardware or software errors, programme errors, computer viruses or unauthorised interventions by third parties as well as mechanical, technical or legal problems.

9 UnIneffectiveness of individual clauses

Should individual provisions of these Conditions of Participation be or become invalid, the validity of the remaining Conditions of Participation shall not be affected. The statutory provisions shall take their place.

10 Transfer, cash payment, legal recourse

No cash payment will be made. The products will only be transferred or delivered within Germany. Any claims are not transferable and an exchange is excluded. Legal recourse is excluded. Applicable law is exclusively the law of the Federal Republic of Germany. However, this choice of law shall not apply to the extent that the participant is deprived of the protection afforded to him by those provisions which, under the law of the country in which the participant has his habitual residence, may not be derogated from by agreement.

11 11 Consumer arbitration

According to § 36 VSBG we inform you that STONELINE is neither willing nor obliged to participate in dispute resolution proceedings at a consumer arbitration board.

12 Data protection information

The personal data provided by you will be processed within the scope of the concluded sweepstake contract. This contract includes your chance to win one of the free product tests specified by us in return for your consent to receive personalised newsletters by e-mail, including analysis of newsletter and competition behaviour.

Your e-mail address, title and full name will be processed to determine and notify the winners and will be stored until the prize determination and notification process is complete.

The personal data you provide in the event of a win (e.g. surname, first name, address, e-mail address, date of birth) will be used exclusively for processing the prize and deleted after expiry of the retention periods under tax and commercial law. The legal basis for this data processing is Art. 6 para. 1 lit. b) DSGVO.

Your e-mail address, postcode, title, date of birth and full name will be used for sending personalised newsletters by e-mail. Your newsletter and competition behaviour is analysed to improve our personalised advertising measures. Further information on data processing in the context of sending newsletters by e-mail can be found in our data protection declaration. The legal basis for this data processing is your consent in accordance with Art. 6 Para. 1 lit. a) DSGVO. You can revoke your consent at any time with effect for the future.

You have the option of voluntarily providing your form of address. We use this information to offer you personalised advertising communication by post or e-mail. The data will be stored for as long as you maintain your advertising consent in accordance with Art. 6 Para. 1 lit. a) DSGVO.

The data may be passed on to service providers and cooperation partners who are contractually bound to data protection for technical or operational support within the scope of the aforementioned purposes. Without providing the mandatory requested data, participation in the competition and its processing is not possible.
